United Airlines - Will not pay out compensation for our 10 hour delay
We were supposed to travel from Manchester UK to JFK New York on 22 October 2014. Waited and waited and eventually staff said flight been cancelled due to flight crew illness and initially gave us a form to claim the allowance of 600 euros per person. We ended up on a plane to Heathrow then eventually on another to JfK but were 10 hours late. We wrote and complained asking for the compensation but they refuse to pay out saying :
United flight UA80 from Manchester, England (MAN) to New York/Newark, NJ (EWR - Liberty) on October 22 is cancelled due to flight crew availability.
We wrote stating The judgment of the Court of Justice of the European Union in Tui & others v CAA confirmed the applicability of compensation for delay as set out in the Sturgeon case. As such, I am seeking compensation under EC Regulation 261/2004 for this delayed flight.
Due to the flight length and the length of delay I am seeking €600 per delayed passenger in my party. The total compensation sought is €2400. they have sent four 200 dollar electronic certificates and will enter in to further correspondence. We are taking this matter further.
